Workplace Accidents

An employer has a legal obligation to provide a safe workplace for his employees as well as for lawful visitors on his property. In Massachusetts, an employee injured in the course of his employment is entitled to receive workers' compensation benefits as his/her sole remedy against the employer. In addition, an employee may bring a civil lawsuit against a responsible third party for damages for his/her injuries arising out of the workplace accident. Such employees, include but are not specifically limited to, firefighters, police officers, corrections officers, iron workers, laborers, carpenters, millwrights, electricians, painters and joiners, operating engineers, crane operators, plumbers and pipefitters, warehouse personnel, truck and delivery drivers, security guards, office workers, hospital and medical staff, linesmen, data and telecommunication workers, utility workers, hotel and restaurant personnel, longshoremen, ship builders and harbor workers, underwater divers, fishermen, airport personnel, highway construction and maintenance personnel.
